What is the 28 days rule?
Nebraska Department of Labor needs to receive your WOTC form within 28 days of the employees hire date.
Can I rehire someone in order to comply with the 28-day rule?
No! Employees who have previously worked for you or is a member of your family are not eligible.
Is there a minimum length of employment required?
The WOTC amount an employer is eligible for depends on the hours the new hire works. All new hires must work a minimum of 120 or 400 hours to qualify.
Can Non Profits or Tax-exempt Employers Apply?
Qualified tax-exempt organizations described in IRC Section 501(c) and exempt from taxation under IRC Section 501(a), may claim the credit for qualified veterans who begin work on or after Dec. 31, 2014, and before Jan. 1, 2020.
*Tax-exempt employers may not claim the WOTC for other targeted group members.
Can I carry forward tax credits not used?
Yes, WOTC tax credits rules are the same as general business credits. You can carry forward unused tax credits for up to twenty (20) years & back one (1) year.
How do I file for WOTC?
After the required certification is secured, taxable employers claim the tax credit as a general business credit against their income tax. InsurPayroll is very CPA friendly, we will provide your accountant with forms & instructions if necessary.
Can my accountant do this?
Many accountants prefer to refer their clients to us. In fact, most of our clients are referrals from accountants. It's hard for CPA’s to have all new hires complete IRS Form 8850 within 28 days of their start date, and submit it with back-up documentation as often as required. Screening for WOTC is included in our HR Services.
